1. Status as an Intermediary (IT Act 2000, Section 79)

IndiaResellAI operates strictly as an "Intermediary" as defined under Section 2(1)(w) of the Information Technology Act, 2000 and is protected under Section 79 of the Act and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

IndiaResellAI does not initiate the transmission, select the receiver of the transmission, or select or modify the information contained in any listing posted by users. The responsibility for the genuineness, ownership, and legality of any item or service advertised rests exclusively with the user who created the listing.

2. Prohibited Content & Fraudulent Schemes

Users are strictly forbidden from publishing listings that contain:

• Counterfeit goods, replicas, fake identities, or cloned Aadhaar/PAN documents.
• Multi-level marketing (MLM), Ponzi schemes, guaranteed investment returns, or crypto doubling fraud.
• Adult, sexually explicit, or escort services.
• Narcotics, weapons, explosives, or any hazardous materials governed by Indian penal codes.

Automated keyword filtering and human audits are conducted. Violations will result in immediate delisting and reporting to appropriate cyber-crime authorities.

3. Zero Platform Commission & Peer Transactions

IndiaResellAI does not collect brokerage, listing fees, or transaction percentages. All payments, inspections, and handovers take place directly between buyer and seller. Users are strongly advised to inspect goods physically before transferring funds.

4. Seller Sole Ownership Warranty & Absolute Limitation of Liability

No Stolen Goods Warranty: Any user who posts an ad affirms that the item is their own lawful property, is free from liens or theft reports, and is completely legal under Indian penal laws. Stolen, lost, or illegally acquired items are strictly forbidden. The poster assumes all civil and criminal liabilities arising from any listing.

No Platform Liability: IndiaResellAI is not a party to any transaction and does not verify physical ownership, condition, safety, or legal title. The platform disclaims any and all liability for theft, fraudulent claims, non-delivery, damaged goods, or financial damages arising from interactions between users.

Mutual User Responsibility: Both buyers and sellers act entirely at their own risk. It is the buyer's sole obligation to check and verify the item prior to purchase, and the seller's sole obligation to verify legitimate payment.

5. Strict Anti-Scraping Prohibition & Legal Enforcement

Prohibition of Automated Crawling & Data Mining: Any extraction, harvesting, scraping, systematic copying, or automated querying of IndiaResellAI's website, listing text, telephone numbers, photos, prices, or database records using bots, spiders, crawlers, or automated scripts is strictly prohibited.

Legal Actions for Violations: Any individual, business, or entity that initiates or facilitates automated scraping of IndiaResellAI will face immediate technical and legal counteractions, including:

• Immediate IP/ASN block and permanent ban across our edge firewall network.
• Civil lawsuit for damages, recovery of illicit commercial gains, and recovery of server infrastructure costs.
• Criminal action under Section 43 (penalty for unauthorized data extraction/download) and Section 66 (computer related offenses) of the Information Technology Act, 2000.

6. Uploaded Listing Storage, Platform Usage & Proprietary Rights

Platform Storage & Utilization: All listing information, media files, and descriptions uploaded by users are saved, processed, stored, and utilized by IndiaResellAI across its global edge network to operate and optimize the marketplace.

Ownership of Database & Digital Assets: While the seller retains title to their underlying physical goods, IndiaResellAI owns the compiled database, platform layout, digital presentation, and catalog records created on this site.

License Granted by Poster: By posting on IndiaResellAI, the user grants the platform a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to display, archive, format, optimize, and legally defend the listing content against unauthorized scraping, mirroring, or exploitation by third parties.

7. Statutory Grievance Redressal Officer (Rule 3(2), IT Rules 2021)

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Consumer Protection (E-Commerce) Rules, 2020, IndiaResellAI has designated a Grievance Redressal Officer:

Users may file complaints regarding listing violations, intellectual property infringement, impersonation, privacy concerns, or abusive behavior.

Pursuant to Rule 3(1)(j) of the IT Rules 2021, IndiaResellAI maintains a designated single point of contact for round-the-clock coordination with law enforcement agencies (LEAs), cyber cells, and CERT-In:
